Toby’s patent practice lies principally in the fields of pharmaceuticals and chemistry. He specialises in drafting and prosecuting patent applications relating to pharmaceutical products (including new chemical entities, peptide therapeutics, pharmaceutical formulations, polymorphs, salts, new medical uses and dosage regimes), cosmetic products (including hair and skin care products), polymer chemistry, analytical chemistry and nanotechnology.
Toby has extensive experience of opposition and appeal proceedings before the European Patent Office, and regularly represents clients in relation to such matters. In particular, he has successfully defended a number of European patents protecting key pharmaceutical products, including patents directed to new chemical entities and pharmaceutical formulations.
Toby works directly with the in-house patent departments of a number of global corporations, advising in relation to matters ranging from the drafting of new patent applications to contentious inter partes proceedings. He has also been retained for a number of years by a major global corporation, advising in an in-house capacity in relation to prosecution and opposition matters.
Toby’s clients include Schering Corporation/Merck & Co., Inc., The Procter & Gamble Company, Ironwood Pharmaceuticals, Inc., Momenta Pharmaceuticals, Inc. and Oxford University (Isis Innovation Limited).
